    On-call not getting paid. Help.

    Hello,

    My boss isn't paying me. I work an oncall schedule, and have worked 3000+ hours of oncall pager work. Meaning I have to be available within a 30 minute time frame of being called. This has dramatically affected my personal life considering there is no standard call rotation between myself and other workers. They promise to pay, but 6+ months later the topic seems to be danced around. I would like to avoid quitting/losing my job. Any advice is greatly appreciated.

    Reply: They have a legal responsibility to pay you. Ask one more time for payment, ask your boss to validate, (in writing) the hours you've worked that you haven't been paid for yet. Wait no more than a pay period for payment. Then file with your State a Wage Dispute Form. If you're fired, then file a Discrimination and/or Wrongful Termination Claim. They're breaking the law. They are subject to State and Federal penalties, and you could be compensated above and beyond what they already owe you. Stand up for yourself! Good Luck
